One of the most common forms of property disputes are over the position of boundary lines. This debate can be triggered by many reasons such as the replacement of a wall, fence, or hedge. What can start as a small argument can escalate and require legal advice. The law in this area is complicated and difficult to interpret, it is essential to seek professional legal advice before progressing with further action.

How do you establish boundaries?

Every property has a title plan filed with the HM Land Registry. The initial step to establish boundaries should be to examine the earliest title of deeds, as these are the legal paperwork that transferred the proof of ownership from one person to another.  The HM Land Registry can also supply copies.

The title register – this includes the title number, who owns it and what they paid, and whether there were any rights of way across the land.

Title plan – the location of the property and general boundaries.

Unfortunately, if there is no precise record of a boundary one will have to be created and an  agreement reached with your neighbour.
