What is professional negligence?
Professional negligence is when a professional fails to perform their responsibilities to the required standard or breaches a duty of care. This poor conduct can result in a financial loss, physical damage, or injury of their client.
Do I have a claim?
To bring forward a professional negligence claim you will need to fulfil all three of the following elements:
Duty of care – you have entered into a contract, which may have been a verbal contract, meaning you were due to have a duty of care. A duty of care is a moral and legal responsibility to ensure the safety or wellbeing of others.
Breach of Duty – The professional such as a solicitor, accountants, financial advisers, did not conduct a service to the best of their ability.
Loss suffered – You have suffered a loss because of the professional’s negligent actions.
