Are you suffering from domestic abuse?
There are two types of emergency applications available to protect you and your children.
- You can acquire an occupancy order to limit your partner’s use of the family home. It is usually a temporary measure, and the length of the Order will depend on your circumstances; but, in most cases, it will last between six and twelve months, unless you apply to renew it.
An occupancy Order can only be issued for a property where both of you live, have lived, or intend to live as the Family Home. When applying for an Occupation Order, a variety of factors must be considered, and our family lawyers will provide you with specific advice and explore your choices with you.
- A non-molestation order protects you by prohibiting the abuser from using or threatening domestic violence, harassment or communicating with you.
To make an application for a non-molestation order, you must have an association under the ‘Family Law Act 1996’ with your abuser. This includes you were/are married, civil partners, cohabiting or partners, relatives, and in-laws.
If your abuser breaches the order, you can enforce it by reporting them to the police to begin criminal proceedings or start civil proceedings by applying to the family court, this can result in the abuser being arrested.
