Do I have to reach a financial settlement?

It is not necessary to reach an agreement though if you do not reach one, it is possible your spouse or partner could attempt to make a financial claim against you in the future.

How do you resolve financial matters?

It is extremely important to resolve financial matters following a divorce. We will support you to negotiate a financial settlement with your husband, wife, or civil partner. If this is possible the terms of the agreement will be incorporated into a written Court Order which becomes binding on both parties.

What happens if we can’t reach an agreement?

In circumstances where there is not an agreement for a financial settlement, our family solicitors will suggest mediation to help you establish an agreement. If this doesn’t lead to a divorce settlement being agreed on, we can make a financial application and represent you in the County Court.

What is a County Court application?

An application to the court will put a settlement in place, they do this by assessing factors such as:

  • Both of your ages
  • Your future earnings potential
  • Assets including money you both own

The court will always put the interests of any children first when deciding on a divorce financial settlement.
