What is an executor dispute?
When there are multiple executors acting together for the administration of an estate, it is common for disagreements to arise. For probate to move forward the joint executors must resolve matters.
What happens if executors cannot reach an agreement?
Communication is crucial, the executors may be able to reach a mutual agreement by talking through their issues. If no agreement has been reached, the next stage is to seek independent legal advice as the estate administration is unable to progress. It is possible for one of the executors to apply to the Court to have the other removed if it is in the best interest of the estate, this would fall under the Administration of Justice Act 1985.

As a joint executor, you can appoint a probate specialist to deal with probate on their behalf. Having a professional act on your behalf makes them impartial, taking instructions from the joint executors whilst keeping them and any beneficiaries updated throughout the process.
