What is The Inheritance Act?
The Inheritance Act 1975 is a law that protects those who were financially reliant on another person when they die. If the Will does not offer an appropriate amount of inheritance, the person who was dependant is able to make a claim.
Who is covered by The Inheritance Act?
The people who are covered by The Inheritance Act include:
- The spouse or civil partner of the deceased
- Children, both adults and minors, including adopted and stepchildren.
- An ex-spouse or civil partner who has not remarried.
- A person who lived with the deceased for at least 2 years prior to their death.
The court will determine if you fall into one of these categories and will consider several variables before deciding whether you have an inheritance dispute claim.
Is there a time limit?
There is a time limit of 6 months from the date the Grant of Probate is issued for claims to be started.
