Can I enforce a promise?

Did you get promised something to be passed on to you, but it wasn’t mentioned within the Will?

In some instances, a promise made by a person before their death can be enforceable even if it was not specified in their Will. This is known as proprietary estoppel, it occurs when you have suffered a financial loss because you expected to receive certain assets.

Do I need proof of a promise?

To prove a promise was made you will need to show:

  • Verbal or written proof there was a promise
  • You relied and acted on that promise, for example, you may have quit your job or took a job for less money.
