Claims for Inheritance
If you have been left out of a Will and you feel that you should have been included there is something you can do about it.
Who can make a claim?
A claim for inheritance is restricted to certain people:
- Surviving spouses
- Children
- People who are treated as a child of the family such as a stepchild
- A person who lived with the deceased for a period of two years or more before death
- A former partner, ex-spouse/civil partner who has not remarried or formed a new civil partnership
- Someone who was financially dependant on the deceased
How long do I have to make a claim?
There is a time limit of 6 months from the date the Grant of Probate is issued for claims to be started so do not delay if you feel you have been unfairly left out of someone’s Will.
