Contentious Probate
What is contentious probate?
Contentious probate refers to any dispute about how a persons’ estate is controlled after their death. It can involve a dispute over the interpretation of a will, a dispute between executors or beneficiaries or a dispute over the value of estate assets.
Is there a time frame for a contentious probate claim?
If you are contemplating challenging or dispute a Will, it is essential for you to seek legal advice as soon as possible. The time you have to contest probate proceedings varies and is dependent on the nature of each claim.
Timeframes you need to be aware of are:
- A beneficiary making a claim against an estate – 12 years from the date of death
- Claiming against an executor for appropriate estate assets – no time limit applies
- Inheritance Act claim for financial provision from an estate – 6 months from date of grant
