Wills

What is a Will?

A will is a legal document allowing you to state what you want to happen to your assets including your money, property, investments, and possessions. Having a Will ensures your young children are provided for once you have passed away.

Are there different types of Wills?

There are different types of Wills available and each suit the needs of an individual’s circumstances.

  • A single Will is for one person regardless of if you have a partner or not.
  • A Mirror Will also known as a joint will are normally used by married and unmarried couples who have similar wishes.
  • Trust Wills are also available these are suitable if you want to provide for your partner but also have children from a previous relationship. Having a trust Will is also beneficial to protect your estate against care home fees.

Why do I need a Will?

  • Name people or charities who you would like to leave your possessions once you have passed away.
  • If you have children who are under 18, you can name who you want to care for them.
  • Choose who you want to protect any inheritance you leave to your children if they are under 18.
  • Specify what items you want to pass on to who they go to.

What happens if I die without making a Will?

In England and Wales, if you pass away without writing a legally valid Will, it is up to the government to decide who gets what. If you have no living family members, all your assets go to the Crown.

If you have children under the age of 18, other people can make decisions about who will take care of them.

Can I state funeral plans in my Will?

You can go into as much detail as you’d like to in regards to your funeral. However, it is to be aware that these requests within your will are only an expression of a wish and is not legally binding.
